Welcome to use the digital asset trading platform operated by McnEx (hereinafter referred to as “we” or “McnEx”, website: www.mcnex.io). Please read this Agreement carefully before using our services. This Agreement constitutes a legally binding contract between you and McnEx, governing your account opening, website access and use of all platform services.
By registering an account, accessing the website or using our services, you confirm that you have read, understood and fully agreed to abide by all clauses of this Agreement, including any content updated from time to time. If you disagree with this Agreement or any part thereof, please stop using the platform services immediately.
1. Service Nature and Risk Warning
1.1 McnEx provides services including digital asset trading, on-chain exchange, wallet access and derivatives trading. We do not offer investment advice, do not guarantee any asset returns, and shall not be held responsible for the consequences of any investment activities.
1.2 Digital assets are highly volatile and high-risk products. Prices may fluctuate drastically or even drop to zero. You shall fully evaluate your risk tolerance and independently bear all risks arising from your operations and decisions.
1.3 All market data, price information, technical indicators and analysis tools are for reference only and do not constitute any express or implied commitment or guarantee. You acknowledge that the Platform is not a financial institution or regulated depositary institution, and user assets are not protected by any government insurance, guarantee or savings protection mechanism.
1.4 All blockchain transactions are irreversible once confirmed. You shall carefully verify transaction addresses and quantities, and shall bear all losses caused by operational errors.
2. User Eligibility and Identity Restrictions
2.1 You must be at least 18 years old and have full capacity for civil conduct, and confirm that you are not located in the restricted jurisdictions specified in Clause 9 of this Agreement.
2.2 If you provide false information or conceal your identity, McnEx reserves the right to terminate services, freeze your account and liquidate open positions immediately.
2.3 We may adjust the scope of available services and user groups at any time in accordance with legal compliance, risk control and business needs without prior notice.
2.4 You shall abide by local tax laws and independently assume all tax liabilities arising from transactions, asset holdings and fund transfers. The Platform does not provide tax advice or declaration assistance of any kind.
3. Account Security and User Obligations
3.1 You shall properly keep your account credentials, including passwords, private keys, two-factor authentication information and other confidential data, and bear full responsibility for all operations conducted under your account.
3.2 You shall not use your account for illegal activities such as money laundering, terrorist financing, fraud, hacking and market manipulation. Otherwise, we have the right to take all necessary measures including account restriction, asset freezing and service termination.
3.3 When we require identity verification, risk investigation and audit inspection in accordance with laws, you are obligated to cooperate and provide authentic information. You warrant that the submitted identity information, address, payment methods and other materials are true and accurate. Any adverse consequences arising from fabricated, expired or misleading information shall be borne by you solely.
3.4 If you access McnEx through third-party tools or platforms (such as wallets and cross-chain services), you shall bear all relevant risks and liabilities on your own.
4. Service Interruption and Limitation of Liability
4.1 We do not guarantee continuous, error-free or fully secure services.
The Platform may suspend operation or malfunction due to maintenance, network interruption, cyber attacks, force majeure and other circumstances, for which we shall not be liable for compensation.
4.2 For order errors caused by system failures, matching abnormalities and interface malfunctions, we reserve the right to unilaterally revise, cancel or dispose of affected orders.
4.3 Any asset losses caused by user’s personal behaviors (such as incorrect address entry, wrong settings and on-chain network congestion) shall be borne by the user.
4.4 The Platform shall not be liable for functional failures or losses caused by abnormalities of third-party services (including but not limited to cloud services, payment channels and node services).
4.5 We shall not assume any direct or indirect liabilities if the Platform is unable to operate normally due to force majeure events such as natural disasters, wars, government control, telecommunication interruptions and supplier failures.
5. Intellectual Property and User Authorization
5.1 All platform content, data, trademarks, images and codes are owned by McnEx or its licensors. Unauthorized reproduction, publication or commercial use is strictly prohibited.
5.2 Any feedback, suggestions and comments submitted by you shall be deemed as a free, global and permanent authorization for McnEx to use.
6. Dispute Resolution and Governing Law
6.1 You agree that in the event of any dispute, the matter shall first be resolved through negotiation with our official customer service.
6.2 If negotiation fails, you agree to submit the dispute to the Hong Kong International Arbitration Centre (HKIAC) for arbitration in accordance with its arbitration rules. The arbitration seat shall be Hong Kong, the proceedings shall be conducted in English, and the arbitration award shall be final and binding.
6.3 This Agreement and related activities shall be governed by the laws of the Hong Kong Special Administrative Region, unless otherwise stipulated by mandatory provisions of applicable laws.
6.4 All information related to arbitration shall be kept confidential.
7. Disclaimer and Indemnification
7.1 Within the scope permitted by law, McnEx shall not be liable for any direct, indirect, incidental, punitive or consequential damages incurred by you in connection with the use of services or platform functions.
7.2 If we suffer losses due to your violation of laws, this Agreement or infringement of third-party rights, you shall bear full compensation liabilities, including but not limited to litigation fees, attorney fees and investigation costs.
7.3 Our total compensation liability shall not exceed the total service fees you paid to the Platform within the past 12 months.
8. Amendment and Termination of Terms
8.1 We reserve the right to update the clauses of this Agreement at any time and notify you via website announcements or other means. Your continued use of the Platform after the update takes effect shall be deemed as acceptance of the revised terms.
8.2 If you violate any clauses of this Agreement, we have the right to terminate your account, restrict services and reserve the right to pursue compensation.
9. Restricted Jurisdictions and User Restrictions
9.1 McnEx does not provide services to residents or entities in the following jurisdictions, including but not limited to: the DPRK, Cuba, Chinese Mainland, Malaysia, Singapore, the United States, as well as any sanctioned countries and regions or other jurisdictions added to the prohibited list by us from time to time (collectively referred to as “Restricted Jurisdictions”).
9.2 It is a violation of regulations if you are a resident, legal person or representative of the above regions, or use the Platform through devices, IP addresses or payment methods belonging to such regions.
9.3 Any form of circumvention is prohibited, including:
• Using VPN, proxy services or relay servers to conceal your location;
• Providing false residential information or identity documents;
• Assisting others in bypassing access restrictions.
4 We may take immediate actions without prior notice:
• Restricting account functions, freezing assets and forcibly closing open positions;
• Disqualifying users from activities or revoking rewards;
• Reporting violations to regulatory authorities and legal institutions.
9.5 You confirm and undertake that:
• You are not a person or institution from any Restricted Jurisdiction;
• You will not provide platform access for users in restricted regions;
• You will actively stop using our services and notify us promptly if your residential status changes.
9.6 We reserve the right to update the list of Restricted Jurisdictions at any time, and you shall be responsible for keeping track of the latest updates of this clause.
10. Miscellaneous
10.1 If any clause of this Agreement is deemed invalid or unenforceable, the validity of the remaining clauses shall not be affected.
10.2 This Agreement is formulated in English as the official version; translated versions are for reference only.

10.4 McnEx reserves the right of final interpretation for the content of this Agreement, platform rules and the identification and disposal of user behaviors.
